Big name U.S. companies have been in the news recently for accessing (and returning) funding from the federal Paycheck Protection Program (PPP), which the SBA has determined flaunts Congressional intent of the program: to aid small businesses in weathering the intense economic downturn caused by COVID-19’s Stay at Home orders. These after-the-fact disqualifications have made small businesses and non-profits concerned about the PPP’s required self-certifications, and left them wondering if their own applications will be eligible for forgiveness under the loosely defined language.
